The attorneys at Koufos & Norgaard, LLC, recognize that most of us work hard all our lives and in so doing we acquire certain assets which we hope to enjoy in our later years. That is why our offices handle all aspects of drafting and probating wills, intestacy proceedings, and administration of estates, from initial petitions and inventories, through all income and estate tax management and compliance, and final accounting and distribution of estate assets. We counsel executors and administrators in marshalling, protecting, investing, and distributing assets. In order for your loved ones to share in the enjoyment of your labors, we strategically plan to preserve your assets.
Proper "estate planning" is the traditional means by which most of us seek to protect our families from the unnecessary depletion of our assets. The most basic tool in any estate plan is the Last Will and Testament. This document clearly recites a person's wishes on how his or her estate will be distributed at the time of death, and also can instruct their loved ones on other matters which are importance to the person making the Will.
In addition, Koufos & Norgaard, LLC, drafts living wills (also know as advanced directives) and Powers of Attorney. A living will allows a person to preemptively make medical decisions in the unfortunate event that they become incapacitated or comatose. A Power of Attorney allows a person to select a trusted individual to make important financial and legal decisions on the incapacitated person's behalf.
Trusts
The attorneys at Koufos & Norgaard, LLC, are deeply experienced in all aspects of trust administration and management, routinely handling Charitable Trusts, Q-Tip Trusts, and Special Needs Trusts. We work with beneficiaries in improving trustee responsiveness in administration and investment matters and any potential or actual breach of fiduciary duty. We also work with trustees in resolving differences with beneficiaries, ensuring that all trustee actions are consistent with the trustee's duty of loyalty, and we are experienced with a host of compliance matters. We handle all types of trust accountings, and address conflicts and differences with the goal of resolution using both alternative dispute resolution techniques and formal litigation in the Surrogate's Court or Superior Court.
