No offer to purchase a home should be submitted without careful consideration of the attorney's role in the transaction. Just about all "standard" real estate contracts contain "attorney approval" or "attorney modification" clauses.
We review the various terms of a contract to determine that the contract does not take advantage of the buyer, typically focusing on the purchase price and personal property included in the sale, the mortgage contingency clause, the inspection clause, and the clause that governs penalties for default. In addition, we ensure that the various pro rata assessments (taxes, water bills, etc.) are fair to the buyer, and that the seller is giving the required disclosures (as to the condition of the property and in some cases as to the status of lead paint in the home) and warranties. If any changes need to be made to the contract, these are made prior to signing the contract or during the attorney modification period.
It is after the attorney review period we order title insurance and a survey (if required by the contract) as well as to satisfy any municipal requirements (inspections, transfer stamps, or water, sewer, and septic tests) that may be necessary before the county will allow the recordation of a deed.
At the closing, we will review all documents produced by the mortgage company and the seller to ensure the Buyer's interests are represented.
