The municipal courts of New Jersey are the average person's most common contact with the criminal justice system. The municipal courts handle most traffic matters, including driving while intoxicated, driving while suspended, speeding, reckless driving, careless driving, and the myriad of motor vehicle offenses set forth in Title 39 of the New Jersey Statues.
The municipal courts of New Jersey also handle less serious crimes, such as disorderly persons offenses, petty disorderly persons offenses, and violations of local ordinances. In other states, these types of offenses are called "misdemeanors", because an offender cannot be sentenced to more than one year of incarceration.
Despite the seemingly simple caseload, the penalties for municipal court violations can and do result in incarceration, suspension of driving privileges, and the assessment of motor vehicle points and insurance surcharges. Therefore, you should contact an attorney to minimize your legal and financial exposure.
